With the UK government continuing its commitment to increasing housing supply in 2026, more buyers are considering newly built homes. While new build properties can offer energy efficiency, modern layouts and lower maintenance costs, there are still important issues to
consider before committing to a purchase.
Jane Bohill, Residential Property Partner with Warners Solicitors, highlights five key things buyers should keep in mind when purchasing a new build home.
- Know exactly what you are buying
Many new build homes are sold “off plan”, meaning the property may not yet be completed. Buyers should carefully review plans, specifications and plot details, as show homes may differ from the finished property. Make sure you understand what is included in the price and what counts as an optional extra. - Consider the wider development
Check when the wider development is expected to be completed and whether roads, drainage, lighting and communal areas will be publicly maintained. Buyers should also ask about any future service charges for shared spaces or facilities. - Understand whether the property is freehold or leasehold
While flats are commonly leasehold, some new build houses may also be sold on a leasehold basis. This can involve ongoing costs such as ground rent or service charges, as well as restrictions on alterations or subletting. A solicitor can explain the implications before you proceed. - Protect yourself against defects
Most reputable developers provide a 10-year structural warranty, but buyers should also expect minor “snagging” issues after completion. Your solicitor can help ensure there are clear arrangements for defects to be corrected within an agreed timeframe. - Choose an experienced independent conveyancer
Developers may recommend their own legal team, but it is important to instruct an independent solicitor who will act in your best interests. An experienced conveyancer can review contracts, check Land Registry plans and ensure the property complies with planning and building regulations.
